These Terms and Conditions ("Terms") govern your use of TopFiveReels ("Service"), operated by R24k Web-Ateljé ("we", "us", "our"), a registered business in Sweden. By creating an account or using the Service, you agree to these Terms.

1. The Service

TopFiveReels is a tool that generates short-form map reel videos from publicly available data. The Service retrieves venue information from Google Places API and OpenStreetMap, renders animated map videos, and optionally uploads them to your connected social media accounts.

2. Accounts

To use TopFiveReels, you must create an account with a valid email address and password. You are responsible for keeping your login credentials secure. You must not share your account with others or allow unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use TopFiveReels only for lawful purposes. You must not:

• Use the Service to generate content that is defamatory, harmful, or violates the rights of others
• Attempt to reverse-engineer, copy, or redistribute the Service's software, rendering pipeline, or map styles
• Use automated tools to create accounts or generate reels beyond your plan's limits
• Misrepresent TopFiveReels content as originating from a source other than your account
• Use the Service to spam social media platforms in violation of their terms of service

4. Content Ownership

You own the reel videos generated through your account. You may use, publish, and distribute them freely on any platform. However, generated reels contain data sourced from Google Places API and OpenStreetMap, which are subject to their respective terms and attribution requirements:

• OpenStreetMap data is licensed under the Open Data Commons Open Database License (ODbL). Attribution is included in the reel automatically.
• Google Places data is subject to the Google Maps Platform Terms of Service.

You are responsible for ensuring your use of generated content complies with the terms of these data providers and the platforms where you publish (YouTube, Instagram, TikTok, etc.).

5. Plans and Pricing

TopFiveReels offers free and paid plans with different feature sets and usage limits. Pricing and plan details are displayed on our website and may change with 30 days' notice. Changes to pricing do not affect the current billing period. Paid subscriptions are billed monthly via our payment processor.

6. EU Right of Withdrawal

If you are a consumer based in the European Union or European Economic Area, you have the right to withdraw from a paid subscription within 14 days of the billing date, without giving any reason. This right applies to the first billing cycle of each new paid plan.

To exercise this right, send a clear statement to info@r24k.se from the email address on your account, stating that you wish to withdraw. Any clear form of communication is acceptable.

Because TopFiveReels is a digital service, access begins immediately upon activation of your plan. By upgrading to a paid plan, you expressly consent to the Service starting before the 14-day withdrawal period ends and acknowledge that the right of withdrawal is lost once the Service has been used to generate or render a reel within that cycle.

If your withdrawal is valid and no reels have been generated during the billing cycle, we will refund the full amount within 14 days of receiving your notice, using the same payment method as the original transaction.

This right does not apply to B2B customers (legal entities or sole proprietors acting in the course of their business).

7. YouTube Integration

TopFiveReels can upload reels to your YouTube channel via the YouTube Data API v3. By connecting your YouTube account, you authorize us to upload videos, set thumbnails, and read video status on your behalf. You can disconnect YouTube at any time from your settings page, which immediately revokes our access. We do not access or modify any content on your channel other than the reels uploaded through our Service.

Your use of YouTube through our Service is also subject to YouTube's Terms of Service (youtube.com/t/terms) and Google's Privacy Policy (policies.google.com/privacy).

8. AI-Generated Content

TopFiveReels uses AI (Anthropic Claude) to generate titles, descriptions, and tags for your reels. This content is generated automatically and may not always be accurate or appropriate. You are responsible for reviewing and editing AI-generated text before publishing. We are not liable for any claims arising from AI-generated content.

9. Data Accuracy

Venue data (ratings, reviews, contact information) is retrieved from Google Places API and OpenStreetMap at the time of reel generation. We do not guarantee the accuracy, completeness, or currency of this data. Ratings and rankings may change after your reel is generated. We are not responsible for inaccuracies in third-party data.

10. Service Availability

We aim to keep TopFiveReels available at all times but do not guarantee uninterrupted service. Rendering times depend on server load and may vary. We reserve the right to perform maintenance, updates, or modifications that may temporarily affect availability. We will communicate planned downtime when possible.

11. User-Uploaded Materials

11.1 Your Content
"Content" means images, text, logos, descriptions, audio recordings, soundtracks, music, and any other materials you upload to TopFiveReels for use in your reels.

11.2 Your Warranties
You represent and warrant that:

• (a) you own or have obtained all necessary rights, licences, and permissions to the Content, including the right to upload, use, reproduce, and distribute it through TopFiveReels;
• (b) you have obtained all necessary permissions from any identifiable individuals featured in the Content;
• (c) you have the right to use any third-party materials shown in the Content, including trademarks, logos, music, or copyrighted works;
• (d) the Content does not and will not infringe the rights of any third party;
• (e) any AI-generated, AI-altered, or synthetic Content is your sole responsibility. You are responsible for complying with disclosure obligations on platforms where the reel is published, including YouTube's altered or synthetic content policy;
• (f) for any audio, music, or soundtrack Content, you have obtained all rights required to synchronise the audio with video and distribute it on third-party platforms. This includes, where applicable, master recording rights, publishing or mechanical rights, synchronisation licences, and performance rights. Royalty-free, Creative Commons, or AI-generated music is only acceptable if the licence under which it was obtained explicitly permits commercial use and synchronisation with video.

11.3 Licence Grant
You retain ownership of your Content. You grant TopFiveReels a worldwide, non-exclusive, royalty-free licence to host, store, process, render, and display your Content for the purpose of providing the Service, including uploading rendered reels to third-party platforms at your direction.

This licence terminates when you delete the Content from TopFiveReels, except that:

• (a) TopFiveReels may retain copies for a reasonable period for backup, audit, or legal compliance purposes;
• (b) rendered reels that have been distributed to third-party platforms (such as YouTube) remain subject to those platforms' terms and are not retrievable or removable by TopFiveReels.

11.4 Prohibited Content
You may not upload Content that:

• (a) infringes any copyright, trademark, right of publicity, privacy right, or other third-party right;
• (b) is defamatory, harassing, threatening, or promotes hatred or discrimination against any person or group;
• (c) depicts sexual content, graphic violence, or the exploitation of minors;
• (d) is unlawful in any jurisdiction where the reel may reasonably be expected to be viewed;
• (e) contains false, misleading, or deceptive claims about a business, product, or service, including fake reviews or misrepresented rankings;
• (f) violates the terms of service, community guidelines, or content policies of any third-party platform where the reel will be uploaded, including but not limited to YouTube.

11.5 Our Rights
We may, at our sole discretion:

• (a) remove any Content we reasonably believe violates these Terms or any applicable law or third-party policy;
• (b) suspend or terminate your account for repeated or serious violations;
• (c) co-operate with law enforcement, regulators, or third parties in response to valid legal process.

We are not obligated to pre-screen Content, and we make no representation that we do so.

11.6 Indemnification
You agree to indemnify, defend, and hold harmless TopFiveReels, its operators, and its affiliates from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from or related to:

• (a) your Content;
• (b) your breach of the warranties in this section;
• (c) your violation of any third-party right through the Content or its distribution.

11.7 Third-Party Platforms
When you direct TopFiveReels to upload a reel to a third-party platform (such as YouTube), you are solely responsible for compliance with that platform's terms of service, community guidelines, monetisation policies, and disclosure requirements (including altered or synthetic content disclosures). We do not independently review your Content for such compliance.

Third-party platforms operate automated content-matching systems (including YouTube Content ID) that may detect and flag audio, music, or video elements in your reels. Any resulting claims, monetisation redirection, blocks, takedowns, strikes, or account actions are a consequence of your Content choices. TopFiveReels has no control over these systems and accepts no liability for their outcomes.

12. Limitation of Liability

TopFiveReels is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, R24k Web-Ateljé is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, data loss, or platform penalties resulting from content generated or uploaded through the Service.

13. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, abuse the Service, or engage in activity that harms other users or the platform. Upon termination, your account data and reel files will be permanently deleted within 30 days.

14. Governing Law

These Terms are governed by the laws of Sweden. Any disputes arising from these Terms or the use of the Service will be resolved in the courts of Sweden.

15. Changes

We may update these Terms from time to time. Significant changes will be communicated via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
